A legal disclaimer

SwasMobility operates an Electric Vehicle (EV) transportation platform. This Privacy Policy explains how we process the personal data of our users (“Data Principals”) in compliance with the Digital Personal Data Protection (DPDP) Act, 2023 and other applicable Indian laws.

 

1. Information We Collect:

We collect only the data necessary to provide our services. This includes:

​

  • Identity & Contact Data: Name, mobile number (verified via OTP), and email address.

  • KYC Data: For corporate or long-term rentals, we may collect Aadhaar details as per transport regulations.

  • Precise Location Data: Real-time GPS coordinates of your pickup and drop-off to facilitate the ride and ensure safety.

  • Transaction Data: UPI IDs, billing addresses, and ride history. We do not store your full Credit/Debit card numbers; these are handled by RBI-authorized payment aggregators.

 

2. Purpose of Data Processing:

In accordance with the principle of Purpose Limitation, we use your data for:

​

  • Providing EV ride-hailing and fleet management services.

  • Generating Eco-Reports (calculating your CO₂ savings).

  • Ensuring passenger safety through real-time trip monitoring.

  • Complying with legal obligations under the Motor Vehicles Act.

 

3. Consent & Your Rights

Your consent is the primary basis for our data processing. Under the DPDP Act, you have the following rights:

 

  • Right to Withdraw Consent: You may opt out of data collection at any time via app settings (Note: This may limit service availability).

  • Right to Correction & Erasure: You can request the update of inaccurate data or the deletion of your account.

  • Right to Nominate: You may nominate an individual to exercise your rights in the event of death or incapacity.

  • Right to Grievance Redressal: You have the right to a timely response to any privacy concerns.

 

4. Data Storage & Localization:

 

Your data is primarily stored on secure servers located within India. We comply with Indian government directives regarding the storage of financial and sensitive personal data within the territory of India.

 

5. Sharing with Third Parties:

We do not sell your data. We only share data with:

 

  • Drivers/Partners: Only essential info (name/location) to complete the trip.

  • Government Authorities: When required under Section 91 of the CrPC or other statutory requirements.

  • Service Providers: Cloud hosting and map services (e.g., Google Maps API).

 

6. Children’s Privacy:

We do not knowingly collect data from individuals under 18 years of age. If a minor uses the service, verifiable parental/guardian consent is required. We do not engage in tracking or behavioral monitoring of children.

 

7. Grievance Redressal Mechanism:

Important Checklist for our Website:

  • Language: The DPDP Act suggests providing this notice in English and any of the 22 languages specified in the 8th Schedule of the Constitution (e.g., Hindi, Kannada, etc.) if your user base is regional.

  • Consent Manager: Ensure you have a clear "I Agree" checkbox that is not pre-ticked.

  • Breach Notification: You are now legally required to notify the Data Protection Board of India and the user in case of a data breach.
